Reasonable Apprehension of Bias
Miracle v. Maracle III, 2017 ONCA 195: The test for reasonable apprehension of bias laid down and consistently endorsed by the Supreme Court of Canada is: what would an informed person, viewing the matter realistically and practically—and having thought the matter through—conclude. Would he think that it is more likely than not that [the decision-maker], whether consciously or unconsciously, w

Trump Says It's Okay For Federal Contractors To Break Employment Laws
Another week, another prediction sadly fulfilled. On December 2, I did a list of executive orders protecting employees of federal contractors that I predicted would be rescinded under Trump. A very important one just bit the dust. The Fair Pay and Safe Workplaces Rule provided two important protections for employees that are now gone: Blacklisting for employment/labor law violations : Anyone apply
New Bills In Florida That Will Impact #Employees If Passed
The Florida legislature is in session through May. They may or may not pass some legislation that will affect employees and employment law. Be afraid. Be very afraid. Here are some of the bills to watch: SB 160 - Minimum Wage : Revising the formula for the adjusted state minimum wage, etc. See HB 945. This is an attempt to slowly bring Florida's minimum wage up to a living wage by adjusting an ex
Climate Change Denial To Be New Protected #Emplaw Category?
Yes, I've been absent for a bit. I was caught up in an arbitration (results unknown at this point) so had a good excuse. Anyhow, I saw this tidbit and had to share it. A Maine lawmaker has proposed a bill that would make an employee's opinions about climate change a legally protected category. To his credit (or maybe he just didn't think it through), although the stated purpose of the bill is to p
Century Foundation Roundtable on Syria
by Aron Lund A lot of Syria writing tends to be focused on current events, veering toward the very small, the very recent, and the very local. We’re all breathlessly racing to keep up with the latest developments in a stunningly complicated conflict, and only rarely do journalists and researchers get a chance to step back and look at the bigger picture. Instead, we find ourselves debating questio
Why the U.S. Should Team Up with the Kurds & Not Turkey to Take Raqqa and Destroy the Islamic State
Why the U.S. Should Team Up with the Kurds & Not Turkey to Take Raqqa and Destroy the Islamic State By Joshua Landis For Syria Comment – March 18, 2017 The problem with letting the Turks take Raqqa and presumably the entire Euphrates Valley that is now held by ISIS is that the Turks are endeavoring to hem in the Kurds. Revenge Being Meted Out on ISIS linked Sunni Tribes of Iraq – FrontLine “Iraq Uncovered”
This Front Line documentary — “ Iraq Uncovered ‘ — on Iraqi Sunni tribes & the revenge that is being meted out on them by Shia militias that follow behind US and Iraqi regular military is a cautionary tail for Syria. The Science Is Not Just Not Settled; It Is False
The American Thinker site has an article, "The Science Is Settled, So Shut Up", referring to the climate alarmism on the political Left, and its tyrannous consequences, but also bringing in other political debates over science. The role of silicon in health and disease - is this the whole grain deficiency syndrome?
You can say what you like about whole grains, but their bran provides an excellent means of concentrating the element silicon from the soil in an absorbable form. Silicon is required for the cross-linking of proteoglycans, the heavily glycosylated protein structures that give tissues as diverse as hair, nails, cartilage, bones, and aortas their resilience. "The major biological function of proteo

George W. Bush & Rob Ford
Recently, there's been efforts to rehabilitate the war criminal (and moron) George W. Bush. Supposedly he respected the news media (when he wasn't lying to them about WMDs) and he isn't as obnoxious as Donald J. Trump. Yes, and for this thin gruel we forgive him his criminal war of aggression against Iraq; his vicious racism, his corruption. This lazy, stupid, ignorant man is now an "elder states
Trudeau Killed Electoral Reform
Just a reminder Liberal partisans: Hero boy has a solid majority. harpercon obstruction and NDP lately deciding they'd agree to a referendum were irrelevant in the face of this majority. What's Going To Happen To Chris Alexander?
I've loathed Chris Alexander since I'd first heard of his existence, back in 2011. That was when he was first running for office as a Conservative candidate in the riding of Ajax-Pickering. He was saying that torture in Afghanistan wasn't a big issue, even though Afghanistan's entire justice/legal system was rife with abuses from top to bottom. But, aside from my own misgivings, the meme about hi

Get a drink. Now. This refugee crisis is an American creation, a parting gift from George W. Bush. We forget what he was, we forget the aftermath of what he did, but how? Whence comes this shallow grave of memory? The corporate "news" media, for their part, are all too happy to help us forget, because in that forgetting they are absolved of any culpability for their harrowing judgment
One day in 1991, a strange letter arrived at the Rainforest Action Network in San Francisco, where Joe Kane was working. It was from members of the Huaorani tribe of Ecuador, wild folks who have lived in the Amazon rainforest for thousands of years. Their jungle home had fantastic biodiversity, including many species that live nowhere else on Earth. The letter said that DuPont-Conoco was planning

i have found the way to make perfect hardboiled eggs (or, in which buzzfeed improves my life)
In Egypt, breakfast almost always includes a hardboiled egg. Even the breakfast cart parked near our bus to Petra had a bowl of hardboiled eggs. And the eggs are always perfect . The shell slides right off, leaving a smooth, perfect white, and a bright yellow yolk. How do they do it? Way back, I posted my method for making hardboiled eggs , which at the time, I thought was perfect. Alas, it was n
should we give up our voip phone and only have cell phones? help me decide.
The ancient technology I grew up with, including the colour. We still have a bit of antiquated technology called a home phone. We use a VoIP phone -- have done since 2002 -- which is why I say "home phone" rather than "landline". Our home phone is not a landline. I've blogged about VoIP in the past: it's reliable, very inexpensive, and easier to use than Skype.* I also like the flat-rate monthly
ontario librarians: should the ola support staffless libraries?
This week, the Toronto Public Library announced plans to open libraries with no staff. Not just no librarians -- we've seen that in many places -- but no staff whatsoever. This was bad enough, but we were further horrified to see that the Ontario Library Association, a membership-based organization that is supposed to further the interests of libraries and librarians, seems to support this idea. O

what i'm reading: a mother's reckoning by sue klebold
On April 20, 1999, Dylan Klebold and Eric Harris, two teenagers from Littleton, Colorado, marched into Columbine High School with explosives and automatic weapons. Three arrested for trafficking 159 ivory tusks
The tusks were stocked in a metallic seal and concealed in the back booth of a car. Said to have been transited from the town of Djoum in the South Region of Cameroon, the suspects disclosed they were taking the tusks to the north of the country. The tusks could have been probably smuggled out of the country into neighbouring Nigeria. They have been kept under seal in the regional service of Came

On the New Statesman Protest
I once attended a demonstration called by the local PCS branch that attracted a mammoth 14 people. Not great, but it was enough to get a hack from the local rag to run a story about their grievances. But have you seen this nonsense about the protest outside the New Statesman offices this evening? Sparsely attended and completely messed up, this just makes Corbyn supporters look mad and brittle. B
Gerard Coyne: Another Reason to Vote Len McCluskey
Got nothing against Gerard Coyne, but in 20-plus years associating with the labour movement I have never seen a candidate run such a desperate and rubbish General Secretary election campaign. Kicking off his Unite leadership bid, Gerard criticised Len McCluskey for spending more time talking about and fiddling with the Labour Party than looking after the welfare of the members. And since then, al
Ken Livingstone and Anti-Semitism, Again
"Ken Livingstone is a massive dickhead. It's high time he acted like a member of the Labour Party, not the Ken Livingstone Party. I and many thousands of activists, including plenty on the left, are fed up with his frequent foot-in-mouth moments that damage his own reputation, that of Labour's new leadership, and the standing of the party as a whole." That was me, just shy of a year ago and nothi
Postcapitalism - A Belated Review
Is capitalism coming to an end? Perhaps not its end, but it is facing a number of difficulties. These aren't episodic issues that can simply be reformed away by enlightened politicians or ironed out by a spot of Keynesian demand management here and there. They are structural, fundamental, and would require a political struggle and defeat of whole sections of capital for them to be sorted out. Thi

Shining in the Darkness for the MegaDrive/Genesis
I got into table top role playing games before my trusty MegaDrive came along, and so was attracted to them as RPGs drip-dripped onto the system in the early part of its life. The problem was as larger games with battery back up, they tended to weigh in with a heftier asking price. Seeing the second and third installments of the Phantasy Star series come with £60 and £50 price tags respectively (
Behold the anti-Trumpers in all their glory...
and weep for our country. This display of disgusting behavior is brought to you by the anti-Trumpers as they marched to Ivanka Trump's neighborhood to hold a gay dance protest about something or another. The irony of the "Protect Our Common Home" sign is surely lost on these writhing denizens of the deep. How about the disruption to an entire neighborhood - most of whom are likely libtards? There

There’s interesting news this morning about planets around M-dwarfs. A team of astronomers led by John Southworth (Keele University, UK) has detected an atmosphere around the transiting super-Earth GJ 1132b. While we’ve examined the atmospheres of gas giants and have detected atmospheres on the super-Earths 55 Cancri e and GJ 3470 b, GJ 1132b is the smallest world yet where we’ve detected one. 39

With my own memories of the July 4, 1997 landing of Mars Pathfinder at Chryse Planitia as fresh as yesterday, it’s hard to believe that we are looking at the 20th anniversary of rover operations on the planet. But as the Curiosity rover continues its travels and we look toward the Mars 2020 rover mission, we’re also taking a much longer look ahead at the worlds where life may be more likely to be
‘Blue Binaries’ Argue for Smooth Neptune Migration
We’re getting a few clues about the nature of planet migration in the early Solar System thanks to a class of objects being described as ‘blue binaries.’ Cold Classical Kuiper Belt Objects (CCKBOs) are generally reddish, but a population of widely separated binaries has now been identified that is thought to have originated in the inner edges of the Kuiper Belt. The paper reporting on this work a
New Options for Locating Fast Radio Bursts
Our catalog of distant, highly energetic events continues to grow. On the Fast Radio Burst (FRB) front, we have the welcome news that the Molonglo radio telescope some 40 kilometers from Canberra, Australia has undergone extensive re-engineering, a project that is paying off with the detection of three new FRBs. The telescope’s collecting area of 18,000 square meters and an eight square degree fi
New Horizons: Star Fields Beyond
The attitude you bring to a star field changes everything. When I was a kid trying to figure out how to use a small telescope, I scanned the usual suspects — the Moon, Saturn and its rings, the Galilean satellites of Jupiter — all the while planning to branch out into major wonders like M31 or the Ring Nebula in Lyra. But when I turned to deep sky objects, what I discovered was that I could see l
Fast Radio Bursts: Signature of Distant Technology?
We have a lot to learn about Fast Radio Bursts (FRBs), a reminder that the first of these, the so-called Lorimer Burst (FRB 010724) was detected only a decade ago. Since then we’ve found 16 others, all thought to be at cosmological distances. The 2015 detection of FRB 150418, at first thought to have left an afterglow, has now been traced to an active galactic nucleus powered by a supermassive bl

my gold/silver metallic paints eventually arrived direct from the paint manufacturer and, while the sun was out, I did some more pair paintings on stretched canvas. Gordon Keirle-Smith - Genesis Antarctica - The Secret Origins of Humanity
In 1974-5, artist and copywriter Gordon Keirle-Smith wrote a treatment for a trinity of novels called Genesis Antarctica: The Secret Origins of Humanity and submitted it (unsuccessfully) to a publisher. In 1962 a cache of ancient urns was discovered in Antarctica dating back tens of thousands of years. They contained writings proving our ancestral myths and lore are actually rooted in the history
Ridley Scott - Covenant poster - Aliens vs Engineers
"You want aliens, I'll give you aliens," that's what Ridley Scott said in response to the dirth of alien material in his so-called prequel to his classic Alien (1979). And boy has he given us aliens (vs engineers) in this new Alien Covenant poster from Fox.
Scarlett Johannsen - Ghost in the Shell - first five minutes clip

BWorld 119, Seven myths in the mining debate
* This is my article in BusinessWorld on March 15, 2017. The endless debate in mining is largely fueled by endless myths and disinformation that fan more emotionalism than reason. Below are some of these myths and the realities behind these half-truths. 1 Mining provides a small contribution to GDP, only P70 billion a year in gross value added (GVA). Wrong. Mining GVA is P85 billion a year, avera
Energy 92, Asia retains big coal use
Why Is Asia Returning to Coal? The fossil fuel is undergoing an unexpected renaissance in the region. By Grace Guo February 17, 2017 "For Japan, coal has emerged as the best alternative to replacing its 54 nuclear reactors, which are deeply unpopular with the population and seen as symbols of devastation after the Fukushima Daiichi nuclear disaster six years ago... But why did Abe go with coal an
BWorld 118, Regulate this, prohibit that: bureaucracies in transportation
* This is my article in BusinessWorld last March 14, 2017. Traffic congestion is an engineering problem with engineering solutions, not bureaucratic solutions involving increased prohibitions. The recent plan of the Metro Manila Development Authority (MMDA) to extend the car ban on EDSA to certain hours five days a week is very idiotic and arbitrary. Its plan is (a) the existing one day a week, 7
Climate Tricks 61, Obama's $1B transfer to the UN climate fund
This is a delayed post. I gathered these news reports in mid-January 2017, about 1-2 weeks before Donald Trump would be officially inaugurated as the next US President. There was a debate in the US then, whether the US' commitment to the Paris Agreement in 2015 was a treaty (would necessitate Senate ratification) or an Executive agreement. The White House under the previous administration argued
BWorld 117, Energy bureaucracy, electric cooperatives and NEA
* This is my article in BusinessWorld last March 08, 2017. The Philippines experienced a seemingly energy revival in 2016 and 2017 with plenty of new power plants commissioned and running. Mindanao experienced an energy surplus after many years of frequent involuntary “Earth hours” or almost daily blackouts lasting for many hours. So it is ironic that while new power capacity were added into the
Drugs War 4, The NYT documentary
There is a new NYT documentary , I watched it but was not able to finish it, I stopped. More than the sights of so many dead bodies on the streets (zero trial, zero investigation, zero hearing of the other side, just shoot-kill-obosen), it's the pain and crying of the family members that struck me. Even if I'm not exactly a fan of the NYT. When my Mama died 1 1/2 years ago and my Papa died 3 week
